These Terms of Use govern your use of the Winzos website and mobile app (the "Service"), operated by Bajaar LLC. They apply when you enter contests, ask questions, earn contest entries or Pointcoins, or redeem rewards. Please read them carefully. They include a ban on reverse engineering, including any attempt to do so (Section 8), and a binding individual arbitration agreement, class-action waiver, and jury-trial waiver (Section 12). By accessing or using the Service, you agree to these terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
Each contest on our platform has its own specific rules and requirements. By entering a contest, you agree to abide by those specific rules in addition to these Terms of Use. The Creator who runs the contest is responsible for those rules and for prize fulfillment.
The Winzos mobile app is part of the Service. Winzos In-Store is optional. If you tap Allow store visits and choose Allow all the time on Android, or Change to Always Allow on iPhone, we use background location to detect a participating store while the app is closed. Contest entries are added after you close the in-store offer. Entries are not guaranteed, and a store visit does not add Pointcoins. You may not falsify, spoof, or otherwise misrepresent your location. Turning location off in your device settings, or signing out, stops monitoring.

All content on the Service, including text, graphics, logos, and software, is the property of Bajaar LLC or its licensors and is protected by intellectual property laws.
You may not, and may not attempt to, reverse engineer, decompile, disassemble, decode, or otherwise derive or discover the source code, object code, underlying structure, ideas, or algorithms of the Service, or of any software, documentation, or data related to the Service. This applies whether you act directly or through a third party, and regardless of the method used.
Without limiting the above, you also agree not to, and not to attempt to:
Any attempt to do any of the above is a material breach of these terms. We may terminate your access immediately and pursue any other remedy available to us, including injunctive relief.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Bajaar LLC makes no warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Your use of the Service is at your sole risk. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that store visits will be detected or that contest entries or Pointcoins will be credited.
To the maximum extent permitted by law, Bajaar LLC and its directors, employees, partners, agents, suppliers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, contest entries, Pointcoins, or other intangible losses, resulting from your access to or use of the Service, or your inability to access or use it, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, Bajaar LLC's total liability to you for all claims arising out of or relating to the Service or these terms is limited to the greater of one hundred U.S. dollars ($100) or the amount you paid us for the Service in the twelve months before the claim arose.
You agree to defend, indemnify, and hold harmless Bajaar LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Service, your violation of these terms, or your violation of any rights of another.
Please read this section carefully. It requires you and Bajaar LLC to resolve disputes through binding individual arbitration. It waives your right to a jury trial and your right to participate in a class action.
You and Bajaar LLC agree that any dispute, claim, or controversy arising out of or relating to these terms or the Service (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this agreement. The arbitration will be held in Travis County, Texas, or by telephone or videoconference. You may also bring an individual claim in small claims court if it qualifies.
Disputes will be resolved on an individual basis only. You and Bajaar LLC waive any right to bring or participate in a class, collective, consolidated, or representative action, including a private attorney general action. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.
If for any reason a Dispute proceeds in court rather than arbitration, you and Bajaar LLC each waive any right to a jury trial. Either party may seek injunctive or other equitable relief in court for actual or threatened infringement or misuse of intellectual property, or for a breach of Section 8.
You may opt out of this arbitration agreement and class-action waiver by emailing help@winzos.io with the subject line "Arbitration opt-out" within 30 days of first accepting these terms. Include your name, the email or phone number on your account, and a clear statement that you want to opt out. You may instead mail that notice to Bajaar LLC, 14425 Falcon Head Blvd, Bldg E, Suite 100, Austin, TX 78738. Opting out does not affect any other provision of these terms. If the class-action waiver is found unenforceable as to a particular claim, that claim will be litigated in court and the rest of this section will still apply.
These terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Subject to Section 12, the state and federal courts located in Travis County, Texas have exclusive jurisdiction over any Dispute that is not arbitrated, and you consent to personal jurisdiction there. Our failure to enforce any right or provision of these terms is not a waiver of that right. If any provision is held invalid, the remaining provisions stay in effect. Sections 8, 9, 10, 11, and 12 survive termination.
We may change these terms by posting the new version on this page. Continued use of the Service is acceptance of the change. If you do not accept a change, stop using the Service and ask us to delete your account. You can do that in the app with Delete my account, or by emailing help@winzos.io.
